The court did not allow the defenders of Viktor Yanukovych, who is accused of treason, provide legal assistance to Russia during the interrogation of the former President.
This was announced by the presiding judge Vladislav Devyatko during the regular meeting, March 21, Obolonskiy district court of Kiev.
So, the lawyers went to court with a petition, which noted that Yanukovych is not able to personally come for interrogation, as there is a “threat to his life and health.”
At the same time they believe appropriate legal assistance to competent authorities of Russia during the interrogation of the President-the fugitive by videotapes.
Also asked for a written decision with references to the specific article, in case of refusal, they can appeal to the European court of human rights.
In turn, the prosecutors said that the court once again needs to explain to the lawyers the rights of their client.
The presiding judge Vladislav Devyatko said that Yanukovych has the right to participate in the meeting by video conference at each meeting.
“At the same time I draw your attention that Yanukovych is accused of treason against Ukraine in favor of the Russian Federation, as well as aiding the change of borders of the territory of Ukraine in favor of the Russian Federation, as well as aiding in the conduct of aggressive actions of the Russian Federation against Ukraine”, – he said.
“Therefore, the participation of the competent authorities of Russia on international legal assistance in this process, contrary to the agreements that have been signed between Russia and Ukraine”, – said the judge.
According to him, Yanukovych may participate in the questioning, but without the involvement of the competent authorities of Russia.
Devyatko noted that the court provided to the defense technical possibility for interrogation of their client by video conference from Russia, but Yanukovych this opportunity to consciously not use it.
He also said that the imposition of a separate decision on this issue in the legislation.
After that, the judge asked to postpone consideration of the applications of the defenders, which, according to him, yesterday he received as many as 30, after questioning the witness Oksana Medieval.
As we know, Viktor Yanukovych is suspected of committing crimes under part 1 of article 111 (high treason), paragraph 5 of article 27, part 3 of article 110 (intentional complicity in acts committed with the aim of changing the boundaries of the territory and the state border of Ukraine) and part 5 article 27, part 3 of article 437 (aiding in waging aggressive war) of the Criminal code of Ukraine.
