The court withdrew the arrest house and land of the father of the former head of the National Bank and ex-Vice-the Prime Minister Sergey Arbuzov.
This decision was published in the register on 20 July, accepted Pechersky regional court of Kiev.
“To cancel the arrest imposed by the ruling of the investigating judge of the Pechersk district court of Kyiv 15.02.2016… property PERSON_2 (father Arbuzov – NC)” decided the judge.
It is about the house area 415,9 square meters and two plots of land: 0,1158 and 0,1798 hectare. According to the materials of the case, the house the father of ex-official was acquired in 2012, and the land is owned since March 2014.
The property has been arrested in the investigation of the embezzlement Sergey Arbuzov.
In its petition, the lawyer noted that his father, Gennady Arbuzov, “is irrelevant to the criminal proceedings… not have the status of suspect or accused”.
In addition, according to the defense, the prosecution has not proved their property of the father of the former head of the national Bank thanks to the actions of the son.
So, the court referred to the information of the fiscal service, according to which from 1998 to 2017 the father Arbuzov earned 5 153 630 hryvnia.
“Given the above, currently, there are no reasonable grounds to believe that PERSON_2 (Gennady Watermelon – pack) has obtained the property by illegal means and it received revenues from the committed crime”, – has decided court.
The investigator, at whose request in 2016 assets seized, at the hearing failed to appear and, accordingly, “did not provide evidence in rebuttal of applicant’s arguments”.
Serhiy Arbuzov since 2010 held the position of head of the national Bank, since the end of 2012 – first Deputy Prime Minister. He fled the country after the victory of the revolution of Dignity.
Watermelon is a defendant in a criminal proceedings on the fact of default by the buyer of the stake of OJSC “Ukrtelecom” – LLC “ESU” of the conditions of privatization on the creation of a dedicated telecommunication network special purpose and illegal in its funding for 2012 and 2013 at the expense of the state budget in the amount of 220 million UAH.
In August of 2017, the court allowed the in absentia, to investigate the case of Sergei Arbuzov.
