Reprimand Holodnitsky: the Supreme court refused NABOO

The Supreme court denied the National anti-corruption Bureau at the suit of the commencement of proceedings on the abolition of reprimand to the head of the Specialized anti-corruption prosecutors Nazar Golodnitsky. On Tuesday, August 21, on his page on the social network Facebook announced the press service of the court.

On 21 August the Supreme court of Cassation administrative court adopted a decision, which refused to open proceedings in the case against the National anti-corruption Bureau of Ukraine to the qualification and disciplinary Commission of prosecutors (MPC) on the recognition illegal and cancellation of decisions on the imposition of disciplinary sanctions on nazara Golodnitsky.

In addition to the cancellation of reprimand, NABU asked to oblige the MPC to consider the conclusion of a disciplinary offence in the actions of Golodnitsky and related materials of the disciplinary proceedings.

The court stressed that a court order may be appealed to the MPC decisions taken on the results of the disciplinary proceedings and the right to such an appeal is only the Prosecutor.

“The persons on the disciplinary complaint which the MPC takes the decision, are not subject to disciplinary proceedings and is entitled to judicial review of the decisions of the MPC as a result of disciplinary proceedings and the results of the decision on its opening,” – said the press service.

In case of disagreement with the decision of the Supreme court at NABOO there is a right of appeal to the Grand chamber of the Supreme court.

Earlier, Prosecutor General Yury Lutsenko has signed the reprimand Nazar Golodnitsky.

We will remind, on July 26, the qualification and disciplinary Commission of prosecutors decided to bring the head of the SAP to disciplinary action, applying the penalty to a reprimand, although Lutsenko demanded to fire him.
