Prosecutor General Yury Lutsenko declared that the procedural Committee of the Verkhovna Rada broke the law by returning the submission for the prosecution of people’s deputies Alexander Vilkul, Dmitry Kolesnikov, Sergey Dunaev and Alexander Ponomarev.
He said this in Parliament on Thursday.
“I, as attorney General, had submitted a proposal on the lifting of parliamentary immunity in respect of the four deputies. Unfortunately, I have to say that all these ideas now can not be considered, because all of the requirements of the law on regulation was disrupted in the consideration of this question, and in fact, not addressing this issue,” – said Lutsenko.
According to him, the Committee should consider performance in the presence of the head of the GPU, but was collected separately and returned his papers to the speaker of Parliament as the MPs “do not understand what they have received.”
“This is a flagrant violation of the law on procedure and powers of the regulatory Committee. I regard it as an obvious unwillingness to pass on to the consideration of my presentation in the session hall,” he said.
Lutsenko explained that the return of the submission for the lifting of parliamentary immunity, the Committee could only in two cases: if the view does not meet the requirements of article 218 of the rules, or if no reasoned evidence in the submission, but in any case, the question should be considered only in the presence of the attorney General.
“I was not at the meeting during the consideration of the views of the administration and Kolesnikov. Nevertheless, the Committee returned the submission to the speaker to return the GPU, ” he said.
The head of the GPU stated that it expired all the legal terms for consideration of submissions to the session hall and promised to make them again in late August.
“I will make a presentation on the MPs new to Parliament, but given the fact that the period of your work before the summer holidays coming to an end, I am forced to do at the end of August,” he said.
Lutsenko added that only a court can determine who and what to blame.
“So now I’m standing on the podium to urge to stop playing parliamentary self-defence and to help evade responsibility”, – said the Prosecutor General.
The speaker of the Parliament Andrei Parubiy confirmed the words of Lutsenko that three submissions were returned in violation of the law.
“I want to note that we have an unprecedented case when three views were not decisions on the merits from the Committee. This casts doubt on the whole procedure of removal of immunity”, – he said.
Parubiy added that the Verkhovna Rada can not replace the judicial system.
In turn, the first Deputy Chairman of the regulatory Committee Pavlo Pynzenyk said that this is Lutsenko and Parubiy are breaking the rules.
“There are two people in this room with the tendency to shift the blame on others – the speaker Andriy Parubiy and Prosecutor General Yury Lutsenko. If both these figures and major political figures perform their functions, as does the regulation Committee, perhaps it would be more order in the Verkhovna Rada, the GPU and in General in the country,” he said.
